In a first day wrap-up by a Memphis TV reporter, she said the prosecution isn't seeking the death penalty because it would make it harder to obtain a guilty verdict. With the death penalty off the table, the jury is presumably more likely to convict.
My take? The makeup of the jury detailed above makes this a reasonable assumption.
