Cannot be legal. The school receives state funds. That would be a violation of AZ civil rights laws.
This is from the South African constitution. Take a look at the last line (3)
9. (1) Everyone is equal before the law and has the right to equal protection and benefit of the law.
(2) Equality includes the full and equal enjoyment of all rights and freedoms. To promote the achievement of equality, legislative and other measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination may be taken.
(3) The state may not unfairly discriminate directly or indirectly against anyone on one or more grounds, including race, gender, sex, pregnancy, marital status, ethnic or social origin, colour, sexual orientation, age, disability, religion, conscience, belief, culture, language and birth.
(4) No person may unfairly discriminate directly or indirectly against anyone on one or more grounds in terms of subsection (3). National legislation must be enacted to prevent or prohibit unfair discrimination.
(5) Discrimination on one or more of the grounds listed in subsection (3) is unfair unless it is established that the discrimination is fair.
“The Color Cabaret” is “an opportunity for BIPOC (Black, Indigenous and people of color) students in the School of Music, Dance and Theatre to create performances that speak to their own experience,” according to a description for the performance held the last weekend in January.
So the argument here (such as it is) seems to be that they should not be allowed ('illegally excluded') to put on a show called The Color Cabaret featuring 'BIPOC students in the School of Music, Dance and Theatre creating performances that speak to their own experience' -- is that right? -- because given the vernacular, it makes less sense to put on a show called The Color Cabaret with white students (although I guess white is a color).
I don't see anything wrong with the show in and of itself.
I suppose in the finest tradition of conservatard outrage porn, where thinking is not desired and instead you're just supposed to react, they mean to imply that it would not be OK for white students to put on a show called The White Cabaret featuring white students -- there probably would be objections; it might even be cancelled -- this would not change my opinion about The Color Cabaret -- let them put on their show.

Student paper editorial: White student president ‘out of touch’ for his ‘I am Black History’ shirt
The editorial board of the Syracuse University student paper this week took the brave position that it was “out of touch” for the Student Association president to wear a shirt at a recent event emblazoned with “I am Black History.” ... Because he is white. ... At the February 1 Black History Month Kick-Off, SA President David Bruen, like many others, donned one of the shirts that were available for anyone at an event table.
Bruen is on Twitter (here) -- it's clear he's Jewish, not 'white' (link) -- with pronouns in his Twitter profile -- and wearing a mask.
Holy shit -- no wonder universities are such a fucking mess.
The War Against Boys seems to have been successful to a significant degree.
The above prescient article by Christina Hoff Summers (also Jewish I should add), published in The Atlantic in 2000, would never be published by the same media outlet today.
A minstrel show perhaps this more or less the same as. Cabaret they call it. Conga line dancers or some sort?
