Clearly jurisprudence in America around this general issue is a fucking inconsistent mess intellectually, which creates another mess practically, since no one really knows what is nominally lawful and what isn't -- what will withstand judicial review and what won't.

Without racial/ethnic diversity, none of this would be an issue -- everyone accepts that some Whites are smarter than others, and most have a sense that intelligence/cognitive ability is probably largely inherited -- this only becomes problematic when there are significant average differences along racial/ethnic lines.

So among other reasons, White Nationalism is appealing because it eliminates these problems in a simple, natural way.

Presumably admissions practices were changed because they were deemed 'discriminatory' against another identifiably different group of people, right? -- or are there some absolute standards or criteria that are supposed to govern academic admissions? -- and these can never be changed or challenged?

The concept of 'disparate impact' is fairly well established (e.g. Vulcan Society v FDNY); in contrast, the Grutter v Bollinger SCOTUS ruling held that society has a 'compelling interest' in diversity, which re academic admissions justifies using selection criteria that result in greater racial/ethnic diversity.

Obviously one set of criteria (test scores, GPA, etc) seems more reasonable in an academic setting, whereas other criteria might be better when e.g. selecting firefighters.

Sorting all of this out is not going to be easy.

Unless you're a White Nationalist of course -- then the picture becomes very clear.

And BTW, Asian immigration clearly has a 'disparate impact' on white students -- e.g. Asians account for 40% of Univ of Calif students, which is roughly 2x their fraction of Calif's population -- in Calif, Asians largely displace Whites in Univ of Calif admissions; much less so Hispanics and Blacks -- in Calif, Blacks are only 6.5% of the population, which is less than half their share nationally.
