press release: appeals court ruling sends a clear message that presidents cannot nullify immigration law through executive action, says fair
Superb news!…I just hope that the new regulations the [fake] Biden administration is issuing regarding daca don't give federal courts an excuse to uphold what is a blatantly illegal program.
STEPHEN MILLER @StephenM "daca is not only egregiously illegal, unconstitutional, and harmful to citizens, but one of the most anti-sovereignty programs ever conceived. when a nation adopts the policy that if you smuggle a minor the minor stays for life, then you have no border and child smuggling forever." | | FAIR is available for comment on these issues. | | appeals court ruling sends a clear message that presidents cannot nullify immigration law through executive action, Says fair (october 6, 2022, washington, d.c.) – the following statement was issued by Dan Stein, president of the federation for American immigration reform (fair), in response to wednesday's ruling by the u.s. court of appeals for the fifth circuit declaring the Obama-era deferred action for childhood arrivals (daca) program to be unlawful: "Yesterday, the Fifth Circuit correctly upheld a federal district judge's ruling that the Obama-era DACA program is unlawful. Presidents do not have the authority to exempt entire classes of immigration lawbreakers from enforcement, or provide them with authorization to work in the United States, when federal statutes explicitly bar them from being here or working here. "This ruling could not have been timelier. Building upon what we once thought was the pinnacle of unlawful executive action during the Obama administration, President Biden and Homeland Security Secretary Alejandro Mayorkas have been working around the clock to negate virtually every immigration law on the books. The end result? The worst border crisis in the history of our country with no end in sight. "The response of the Biden administration and congressional Democrats to yesterday's ruling is telling and discouraging, and demonstrates that they are the ones using DACA beneficiaries as political pawns. Rather than showing even the slightest bit of interest in addressing a raging border crisis they created, they called for mass amnesty – and not just for the 600,000 illegal aliens enrolled in DACA, but for upwards of 4 million immigration lawbreakers. Amnesty is their only solution when it comes to Congress exercising its power over immigration, and the American people are taking note. "The multiple immigration crises facing our nation cannot be solved through unlawful executive action or an amnesty bill. They can only be addressed when the White House and congressional Democrats finally decide to act in good faith to restore the integrity of the countless immigration laws to which they have laid waste." The law--as I understand it--is every illegal that sets a foot on our soil is allowed to stay.
No,the courts won't allow that to be changed.

The President would have been given the power to nullify any law at whim. Thankfully the court made the right decision.
"The law--as I understand it--is every illegal that sets a foot on our soil is allowed to stay."
Currently all the illegal has to do is say asylum and they get to stay with a 90 day notice to appear in court. 80 % of them just never appear. And if apprehended at some point beyond the 90 days just get another 90 day notice. Could go on endlessly.
Applying for asylum you are only entitled to apply at the first country you cross the border of. These people from Haiti or Venezuela should not be allowed to apply by that rule.
This might be an impeachable offense for Biden. Among probably many. He is not following the laws with regard to immigration. Mayorkas too. Impeach them both. Cabinet officers can be impeached too.
Also as I understand it if the kid [by now many grown adults] is allowed to stay then the entire famblee is also allowed to stay. Famblee then does chain migration when they become legalized. From one kid you end up with forty more potential "migrants".
