So "the attorney" is probably right.
It's understandable people are upset about the migrants. I assume it's mostly "conservatives". But "conservatives" had control of the federal government in 2017 when the migrant "caravans" started the ploy of masses of migrants applying for asylum. The time to do something to stem it was back then. But "conservatives" did nothing.
Assuming these people have applied for asylum and been set free pending their application, no court in the US would allow them to be arrested.
Any migrant who crosses the border at other than a normal port of entry today is an idiot. Because all they have to do is go to a normal border control point and say they want to apply for asylum.
But even if they don't do that, and instead decide to cross illegally at some other point, all they have to do is say they want to apply for asylum and the result will be the same. Or a court would rule their application still must be considered.

(Fox news)Baseball legend Johnny Bench apologized for using an "insensitive" remark during the Cincinnati Reds’ Hall of Fame ceremony on Saturday night, which came as the team honored the late Gabe Paul.
Jennie Paul, Gabe’s daughter, and Pete Rose were among those who spoke about the former team executive. Jennie noted how her father was Jewish and became a champion of minorities in pro baseball. Rose told a story about how Gabe signed him on a deal that paid him about $400 per month.
After Jennie chimed in with a comment about how her father was "cheap," Bench was heard yelling, "He was Jewish!" The former Reds catcher’s joke didn’t go over well, and he was scrutinized for it.
He apologized in a statement through the Reds.
"I recognize my comment was insensitive," Bench’s statement reads. "I apologized to Jennie for taking away from her father the full attention he deserves.
