It's a legal threat to the US.

German courts have ruled that asylum seekers who previously applied in Greece but then traveled further to Germany (per the Dublin Accord legally not allowed) and applied for asylum in Germany, cannot be sent back to Greece because the standard of treatment in Greece is too far below the standard in Germany.

A German court even ruled the same about Italy.

So migrants from Haiti who are in Mexico waiting to apply for asylum in the US, maybe as part of some "wait in Mexico" program put in place by the US, are in basically the same position as migrants in Greece whose preferred destination is Germany. Actually the Haitians are in a better position, because there is no legal treaty (a "safe third country" agreement) between the US and Mexico regarding asylum seekers.

So if some NGO were to sue the US government about this, a US court could (and likely would) easily rule the inferior conditions in Mexico violate the rights of the Haitian asylum seeker, and they must be immediately admitted to the US and allowed to apply for asylum. And no US government would ignore such a court decision, as Hungary ignores EU court decisions about its asylum policies.

That's "so what".

Because the court systems are joined together,"arm in arm",world wide now,there is apparently no recourse to stop this--except for a complete,rapid,physical replacement of these entities.

Whether a state law forbidding such movement is allowed in the context of federal law--and receiving federal funds if the state enacts such law--is the question.That means,the only way to stop such immigration to come to your state is either illegally(under federal law)or secession.

I don't think Texax Reader wrote So What so much in ignorance that rulings like this may exist but to mock the absurdity of their existence...but yes, it is beyond human reason there are judges that makes these kind of rulings. It's to keep the business of Open Borders Inc. (Michelle Malkin's great book) moving forward.

The way to stop this particular scam at the southern border is for the US to FORCE Mexico sign a "safe third country" agreement so asylum seekers cannot transit thru Mexico in order to apply for asylum in the US. They would have to apply in Mexico. They would be Mexico's problem. The US has plenty of economic and political leverage to force Mexico to reach such an agreement. Trump fucked up his opportunity to do that when the "caravans" started in 2017.

Another way to reduce the problem is to go back to the strict "well founded fear of persecution" reason for granting asylum: an applicant must, AS AN INDIVIDUAL, must be able to make a credible case for having a "well founded fear of persecution". And not just be coming from a shithole country, or where there is temporarily some unrest or conflict. Anyone unable to demonstrate a credible "well founded fear of persecution" would have their application quickly rejected and be unceremoniously sent back to where they came from. Word would quickly spread and they would stop coming.
