The new wrinkle is the behavior of one judge on the three-judge panel at the DC circuit appeals court, one Robert L. Wilkins. His question for the attorneys is, in context, bizarre. And repeated.

The article's author identifies him as an Obama appointee. So that made me go "Hmm." Sure enough:

Wikipedia https://en.wikipedia.org/wiki/Robert_L._Wilkins tells us he has a chemical-engineering degree from Rose-Hulman. The country may be lucky that he went on directly to Harvard for a law degree instead of designing a plant making hazardous chemicals.
