“grand rapids, mich. (wood) — the former grand rapids officer who shot and killed Patrick Lyoya will not stand trial in october.

“on tuesday, the 17th circuit court decided to adjourn the trial because of an ongoing michigan court of appeals case from former officer Christopher Schurr’s team.

“it is not clear when the trial will be held.

“Kent county prosecutor Chris Becker said the adjournment did not come as a surprise because of the progress of the court of appeals case.

“michigan appeals court will consider grpd officer’s case in Lyoya shooting.

“it simply would not be possible to keep the dates set by the 17th Circuit Court as we await a date to be set for oral argument with the higher court reviewing the case,” said Becker in a statement.

Chris Schurr, 31, of Grandville, is charged with second-degree murder for the April 4 killing of Lyoya, 26.

Schurr’s attorneys had moved to have the case thrown out. When that was denied, they appealed to the Michigan Court of Appeals. If that appeal fails, the defense could appeal to the Michigan Supreme Court, delaying things further.

“In february, Sarissa Montague, a criminal trial attorney for Levine and Levine in kalamazoo, said the appeal may delay a trial significantly. Montague said the delays are normal in cases like this and give both the defense and prosecution more time to prepare their cases.

“expert: Schurr trial could be delayed by ‘several months’

“This is the second time the trial has been delayed, having been moved from an original date of march 13 to the oct. 24 date.

GRA: Delay it for 50 years—at least.

Usually the appeals benefit the bad folks only. Not a decent cop doing his job.

He shot the suspect in the back of the head while the suspect was prone on the ground. That's face down.

Watch the video:

https://www.mlive.com/news/grand-rapids/2023/04/the-people-vs-christopher-schurr-where-officers-murder-case-stands-a-year-after-patrick-lyoya-was-killed.html

It's gruesome. Hard to watch that and see the shooting as it happened, in the back of the head, as justified.

To point out the obvious: the suspect apparently had his hand on the cops's taser, not on his weapon. The suspect did not have a gun. So jump off and quickly move well away from the suspect, even if it means the suspect has the taser. Keep the weapon pointed at the suspect. Loudly order him to drop the taser. If he refuses and tries to aim the taser then shoot him. If the cop had done that he would likely be in the clear. It's doubtful he would be charged for shooting someone who disobeyed a clear instruction to drop the taser and was attempting to point the taser at him.

The cop was not at risk from the taser while the suspect had his hand on it and was prone on the ground. Since the cop was not at risk there was no reason for him to use deadly force.

The dead piece of shit should not have been here and the people responsible for his presence ought to be the ones who are shot in the head.

But in total the cop's actions were more stupid than "heroic". And it is very unlikely that he will get off. At the least he ought to be have been fired for getting himself into that position. Seems he was fired after charges were filed.

No opinion about whether he ought to face charges or not. In a different political climate maybe he would be given the benefit of the doubt. Not today though.

Some cops are just stupid and should not be cops.

But the ultimate problem is the black criminality cops are forced to deal with in real-time. Still no fair, reasonable person could watch the video and see the shooting as justified.

" I found - in the Michigan State Police officers guide specifically - you do not ever use lethal force in that situation, even if the guy runs. You let him run,"

The bad guy wasn't running. He had taken the taser away from the cop. Probably thought it was a firearm.

The problem with convicting Schurr with that logic is assuming that the confrontation would end in Schurr's favor. As long as Lyoya was resisting, even with Schurr in a dominant position, the threat of Schurr's life being in danger was still ongoing. No one can predict the future in a fight, so I give the benefit of the doubt to the cop. Schurr thought Lyoya had enough of a grip on the taser to warrant alarm and fear--maybe Schurr was getting tired. If Lyoya had surrendered long before that point of decision,he'd be back out on the street by now.But blacks don't think that way--they don't "think"--period,so surrendering is rarely an option in those situations--and the result IS:they get shot.

"He had taken the taser away from the cop."

He had his hand on it. He was not in a position to use it while face down on the ground with the cop on top of him:

"The cop was not at risk from the taser while the suspect had his hand on it and was prone on the ground. Since the cop was not at risk there was no reason for him to use deadly force."

No idea what will happen in this case. But it is not at all unfair or unreasonable to think the cop should not get away with shooting the suspect in the back of the head in those circumstances. While he was on top of the suspect who was prone on the ground.

Don't care anymore as to what is fair or unreasonable as it applies to THEM. After 2020 and even before that THEY have shown everyone what they are about and have always been about. No sympathy at all for the bad guy that died.
