HOPE TOWNSHIP, Mich. (WOOD) — The Barry County prosecutor has decided that a deputy was justified when he shot and killed a man near Delton last year, saying Jeremiah Johnson had threatened his wife with a gun and was struggling over the weapon with a deputy when it happened.
Barry County Prosecutor Julie Nakfoor Pratt’s decision, released Tuesday after meeting with Johnson’s family, means no criminal charges will be filed in the case.
“It is my opinion that … the deputy honestly and reasonably believed that the use of deadly force was necessary to prevent the imminent death or imminent great bodily harm to his fellow officer, Johnson’s wife … and also himself,” Pratt wrote in a release. “This was a justifiable homicide.”
Johnson’s wife Siphiwe Johnson disagreed.
“The whole thing is one-sided. No matter what I say or don’t say, it won’t change nothing. No one cares,” she told Target 8 Tuesday.
The prosecutor said the deputy opened fire after Jeremiah Johnson drew his gun when confronted and then struggled over the weapon with another deputy.
“The muzzle was pointing in the direction of the (other) deputy’s chest and head and he feared for the (other) deputy’s life so he shot Johnson,” Pratt wrote.
Siphiwe Johnson said she witnessed the shooting and does not believe it was justified. She said her husband was shot five times in the back and side and didn’t fire any shots at deputies. She said her husband served in the U.S. Army in Iraq and suffered post-traumatic stress disorder.
“What happened did not happen the right way,” Siphiwe Johnson said. “I don’t see how there’s any other decision. But I don’t make that decision, sadly. I was there. I saw what I saw and what they claimed they saw is unbelievable. I don’t even understand how… I don’t get it.”
Widow: Husband killed by Barry County deputy did not deserve to die
The shooting happened the evening of Oct. 28. Dispatch recordings from that night show that Siphiwe Johnson called 911 around 7:30 p.m. from their car and again about 20 minutes later from the home on Kingsbury Road near M-43 in Hope Township, reporting her husband was behaving erratically and threatening her with a gun.
GRA:Her motive is obvious at this point.
