Meanwhile, Christopher Schurr’s appeal is denied by the michigan supreme court.
Lansing, mich. — the former grand rapids police officer charged with 2nd degree murder was denied his request for the state’s highest court to take up the case.
“the michigan supreme court on monday issued an order denying the appeal by Christopher Schurr. the fired officer is criminally charged [in] the death of Patrick Lyoya.
“Schurr hoped the michigan supreme court would reverse a ruling by a Kent county district court judge that moved the case closer to trial. nearly 7 months after the appeal was filed, the justices decided the case did not warrant further review.
“in the order issued monday, the court's majority (5-2 decision) noted the opinion to bind the case to Kent county circuit court was within the ‘principled range of outcomes.
“two justices, David Viviano and Brian Zahra, dissented from the ruling, arguing the appeal should have been sent back to the michigan court of appeals for further review of whether Lyoya was in possession of a dangerous weapon at the time of the shooting.”
GRA: I just found out today that Lyoya's blood alcohol content was .29—superdrunk—at the time of the attempted arrest. “he had a drinking problem,” were the reports. Crazy drunks are unpredictable and strong. I think that fact should go in Schurr’s favor—IF the judge allows it into evidence (no sure thing, according to legal wags).
The trial will still take six months—minimum—to get going.

The 12 men and women must now decide whether Penny’s actions were justified when he put Jordan Neely, a mentally ill homeless man, into a headlock on May 1, 2023, and wrestled him to the ground, or whether those actions crossed the line into manslaughter and criminally negligent homicide, as prosecutors allege.
The trial has captivated the attention of much of the nation and the world, and protesters sympathizing with Neely have assembled outside the courthouse at 100 Centre Street almost every morning while it has been underway.
