On December 20, 2011, Laurence Lovette was sentenced to “life without the possibility of parole” for the murder of University of North Carolina student body president Eve Carson.
On Tuesday, the North Carolina Court of Appeals ruled that Lovette must be resentenced because of a U.S. Supreme Court ruling that sentencing someone under 18 to life without parole is “cruel and unusual punishment.”
Lovette was 17 at the time of the murder.
Lovette and Demetrio Atwater (who was 26) kidnapped Eve Carson from her home and drove her in her SUV to two ATMs, where Lovette withdrew $700 from Eve Carson’s bank account.
The two killers then drove Carson a mile from the UNC campus where they shot her five times and left her body in the street.
Security footage from an ATM showed Lovette withdrawing money while Atwater held Carson hostage in the back seat. Lovette “made statements to friends that implicated him in the crime.”
Atwater is serving two “life” terms in federal prison. He “avoided the death penalty by pleading guilty to state and federal charges in the case.”
Lovette was never eligible for the death penalty, because of his age.
Lovette is also charged with the January 18, 2008 murder of Duke graduate student Abhijt Mahato, who was found dead in his Durham apartment.
“According to an arrest warrant, Mahato’s cell phone helped Durham police link Lovette to the crime when he was arrested on March 13, 2008 in Carson’s death.”
Presumably, this means Lovette had Mahato’s cell phone in his possession.
“Lovette has not gone to trial in Mahato’s death. A status hearing is set for Feb. 18 in Durham County Superior Court.”
