Raceless Man Paroled in 2006 for Murder in Convenience Store Robbery, Sentenced for Carjacking His Own Friend in 2008

Quincy Dayco Moutry was paroled in 2006 for a 1995 shooting death of a convenience store clerk in Knoxville, Tennessee.

Moutry and his accomplice, Carlos Devon Jones, pleaded guilty in 1999 to second-degree murder for killing Vernon Ward, 31. Assistant DA Takisha Fitzgerald said Wednesday that Moutry was ordered to serve an 18-year prison term but was freed on parole in 2006.

Special Judge Jon Kerry Blackwood (who replaced Richard Baumgartner) sentenced Moutry to a total of 27 years.

“I can’t say nothing?” Moutry shouted out. Moutry has a history of acting out in court.

“Take it up with your lawyer,” Blackwood responded as bailiffs carted Moutry away.

Here is an individual sentenced to prison for murder, gets out, and commits more violent crimes.

Moutry befriended Sherwood in 2008 and, in March of that year, asked her to meet him at the Burger King on Broadway to chat about his breakup with a girlfriend, prior testimony has shown.

Sherwood arrived in her 1997 Mitsubishi. Moutry got into the passenger side of her car but, rather than chatting, began texting on his phone.

"He opened the door," she testified at a trial earlier this year. "Someone slid in as he slid out."

The new passenger was armed, and a second confronted her on the driver's side, hitting her in the head with his gun, she said. She was rescued by a Burger King employee but not before the unidentified men fled in her car and Moutry drove off in his vehicle, testimony showed.

Defense attorney John Boucher argued at Wednesday's sentencing hearing that Moutry was not armed and did not commit the actual carjacking.

"My client was convicted, I believe, based on (the legal theory of) criminal responsibility (for the conduct of another)," Boucher said.

Fitzgerald countered that Moutry set up the crime.

"Clearly, he was the leader because (Sherwood) did not know the other two defendants," she said….

N.S.: Since Moutry and Jones had committed murder while committing a separate felony—aggravated armed robbery—the killing constituted first-degree felony murder, which made them eligible for the death penalty.

Note that Moutry’s D.O.B. is January 12, 1977. Thus, he was only 18 when he committed his first murder.

And after getting paroled, this is what he does to some poor woman who makes the mistake of befriending him. And for what, an 11-year-old car? Thank goodness, an employee saved her, or Moutry might have murdered her, too—among other things. This man is a plague on society.
