Forgotten man: Murdered Houston policeman Guy Gaddis. The San Francisco Gate (San Francisco Chronicle) posted this photograph last, as an afterthought, in a gallery devoted to Officer Gaddis’ killer, Edgar Tamayo, and even misidentified the photo with the following caption: “Tamayo family members pray outside the Huntsville prison after the Supreme Court rejected his appeals.”

Attorneys for the Mexican national on Texas death row for the slaying of a Houston police officer hoped a civil suit, challenging what they argued is an unfair and secretive clemency process in the nation’s most active capital punishment state would block the inmate’s scheduled execution this week. Tamayo, 46, was set for lethal injection Wednesday evening, Jan. 22, 2014, in Huntsville." (Texas Department of Criminal Justice.)

Notice, I didn’t say, “Texas Justice.” That would have required that Tamayo be executed 20 years ago.

HUNTSVILLE — Edgar Tamayo, a Mexican national whose case gained international attention, was executed here Wednesday for the 1994 murder of a Houston policeman.

He was put to death at 9:32 p.m., three hours after his scheduled execution and after the U.S. Supreme Court heard his final appeals.

Tamayo's execution was the first of 2014, and the first of four convicted Harris County killers scheduled to be put to death in the next four months.

The lethal dose of pentobarbital was administered after Tamayo's final court appeals ended in defeat. Earlier Wednesday, lawyers from the Mexican consulate in Houston traveled to Huntsville to meet with the killer's family.

Tamayo was condemned for the murder of Officer Guy Gaddis, who was shot in the head in January 1994 as he prepared to take Tamayo and another man, both handcuffed in the squad car's back seat, to jail.

Tamayo, trial testimony revealed, extricated a pistol hidden in his clothing and fired the fatal shots.

The case garnered international attention because authorities failed to tell Tamayo at the time of his arrest that he could confer with the Mexican consulate. That right is provided by the United Nation's Vienna Convention on Consular Affairs.

In 2004, an international court held that Tamayo's case should receive judicial review to determine if that violation affected the outcome of his trial. The killer's lawyers argued that early notification of the consulate could have expedited the location of witnesses in Mexico, whose testimony could have allowed Tamayo to escape the death penalty.

Two other Mexican nationals with Vienna Convention violations have been executed in Texas. Jose Medellin, condemned for the 1993 rape-murder of two Houston teenagers was executed in 2008; Humberto Garcia, convicted of killing a San Antonio teen, in 2011.

  1. The Mexicans' love for their beloved American cop killer sickens me. Guy Gaddis and his loved ones mean nothing to them.

About seven or eight years ago, a Mexican serial killer, "The Railroad Killer", was executed in Texas (his name escapes me at the moment.) The Houston Chronicle had the guts to publish a story about how the Mexican government tried to save him. The same pretext about The Railroad Killer's rights being violated was used. One of the family members of one of the victims was quoted as being furious that the murderer had the support of the Mexican government and was trying to interfere with U.S. justice.

A photo of this same family member was published along with the article. It was pretty easy to tell that he was absolutely furious, and rightfully so.

If nothing else, Governor Perry told the Mexicans to butt out the other day. The bastards lost this battle.

  3. I'm not sure what witnesses from Mexico would have done for the case. The man was obviously guilty. Just a ruse without any merit.

  4. This Edgar is described as a Mexican national. More correctly as an illegal alien.

  5. Remember Jose Medellin?

George Bush interfered in his execution.
