Enrique Alberto Machado, the father, has been charged with felony murder, but that charge will not fly. Since there was no bad intent (“mens rea”), but the level of negligence rose to the criminal level, he’ll end up going down for something like Man 2 or negligent homicide.

He also probably lied about how many beers he’d had. He told deputies that he’d had “about six beers” with colleagues, before heading home, but when I was 13, six beers counted as a snack, and among Mexicans and other Hispanic “immigrants” down Houston way, 12 beers or more are the norm. He was probably embarrassed to say how many beers he’d drunk.

After my son was born, I didn’t touch a drink for over a year, and I’ve rarely had a drink since then, out of fear of dropping him.

Machado isn’t an evil guy. I’m sure he loved his baby to death. He’s just homicidally stupid, which is what you get, as a free bonus, with mass, Third-World immigration.

HOUSTON—A Houston father who was drunk while giving his 1-year-old son a bath fell asleep and caused his little boy to drown, according to Harris County Sheriff’s deputies.

Enrique Alberto Machado was charged with felony murder.

The baby’s mother called for help after finding her toddler floating face up in a bathtub full of water on April 27. Her boyfriend, Machado, was asleep on the floor next to the bathtub.

Machado told deputies that he came home from Colorado as a truck driver, drank about six beers with coworkers, then went home and attempted to bathe his son.
That is when he fell asleep on the bathroom floor. He did not realize what happened until the boy’s mother found them and woke him up.

Machado repeated over and over that he was “responsible for everything,” according to documents.

The father’s blood was drawn at Memorial Hermann Hospital. After his son’s autopsy, medical examiners ruled the death a homicide.

Machado’s bail was set at $100,000.
