On Monday, Judge Walter Kurtz ruled that the families of torture-murder victims, Channon Christian and Christopher Newsom, must sit behind the defendant if they want to wear buttons with images of the victims and stay clear of the jury box.

The judge said relatives of the victims can wear the photo buttons they have at previous trials.

"However, Kurtz said if they choose to display the buttons, they must sit 'two or three rows' back from the front bench and behind suspect George Thomas and his defense team."

At the other trials, family members sat in the second row directly behind the prosecution table and within feet of the jury box.

The two other judges, the disgraced Richard Baumgartner and Jon Kerry Blackwood, allowed the buttons and let the families sit where they wanted.

The judge also ruled some photos of the victims will be excluded.

Kurtz did allow the "F*** that white girl" comment Thomas made to a detective to be introduced. The detective waited a year to tell the prosecutors about it.

The retrial is scheduled for May 13. The location of the jury pool has not been revealed.
