Elena Kagan’s Race-Baiting of Antonin Scalia

On February 27, while the U.S. Supreme Court was hearing a case on the Voting Rights Act, Justices Elena Kagan and Sonia Sotomayor proceeded to race-bait white justice Antonin Scalia, to great applause from the racial socialist MSM.

As Dana Milbank of the Washington Post wrote,

“Kagan pointed out that ‘Alabama has no black statewide elected officials’ and has one of the worst records of voting rights violations.”

Kagan lied, Scalia didn’t have the facts at his fingertips, and Milbank is just as much a liar, for covering for her. At least 26 out of the 103 current members of the Alabama state house of representatives are black (25.3 percent!), with four from Mobile County alone: Yvonne Kennedy, Napoleon Bracy, James Buskey and Joseph Mitchell. The rest that I could identify as black were Laura Hall, Barbara Boyd, John Rogers, Demetrius Newton, Rod Scott, Lawrence McAdory, Merika Coleman, Oliver Robinson, Mary Moore, Juandalynn Givan, Darrio Melton, Thomas "Action" Jackson, David Colston, Christopher J. England, Artis J. McCampbell, Ralph Anthony Howard, John Knight, Alvin Holmes, Pebblin Warren, George Bandy, Berry Forte, Dexter Grimsley. Out of 39 state representatives from the Democratic Party, at least a full two-thirds are black. Thus, Alabama’s Democratic party is, for all intents and purposes, a black state party.

In the State Senate, seven out of 11 Democrats are black. The partisan breakdown is 22 Republicans, 11 Democrats, one independent, and one vacancy. The black senators I identified were Rodger Smitherman, Priscilla Dunn, Linda Coleman, Henry Sanders, Bobby Singleton, Quinton Ross, Vivian Figures.

And that’s not getting into the countless number of local and county black elected officials.

If Kagan were to shift her grounds, and say she’s talking about the U.S. House, she’s still lying: Terri Sewell is a black Alabama congresswoman. (The state only has seven congressmen.)

If she were to shift again, and say that none of the executive offices of governor, lieutenant governor, attorney general, secretary of state, state auditor, state treasurer, is held by a black, she still has no point. If a state is permitted to hold democratic elections, and a group is only percent of the population, and its members are of particularly poor quality, that’s to be expected. What Kagan is doing is ignoring those statewide offices that disprove her lie, and saying that blacks must be given executive offices, assuming she didn’t just pull her claim out of the back of her robe.

As for Kagan’s claim that Alabama has the most violations of the unconstitutional Voting Rights Act, I have no idea what she means, but I do not doubt that she is no counting violations by blacks against whites, as if they were the other way around.

Kagan’s criterion of success is clearly one of failure. Unless blacks are in control, any jurisdiction is for her a failure, but if blacks are in control, they invariably run a jurisdiction into the ground, as they have in Birmingham, Alabama, which flourished when it was run by whites. And when Black Power leads to the usual catastrophe, Kagan will surely find a way to blame the failure on whites.

“The Heart of Dixie,” Alabama’s unofficial name, is 66.8 percent non-Hispanic white, vs. 26.5 percent black.
