ALIPAC: Read the Fine Print; Dream Act Amnesty Permits Obama to Amnesty All Illegals

Harry Reid, who is still majority leader of the lame-duck Senate, seeks to put the nation-ending DREAM Act to a vote today. The Act has already passed the House.

From a December 17 press release from Americans for Legal Immigration PAC:

ALIPAC is rallying talk radio show listeners and American citizens to call the US Senate to oppose the Dream Act Amnesty today. The bill contains a waiver that would allow the Secretary of Homeland Security and President Obama to grant Amnesty to most illegal immigrants in America.

"The Dream Act Amnesty is a Nightmare already and would displace several million innocent American students, workers, and voters," said William Gheen, President of ALIPAC. "But now we find a waiver on page 5, line 21 of HR 5281 that allows Obama to grant Amnesty for most of the 12-20 million [sic] illegal aliens in America!"

Close inspection of HR 5281, which passed the house last week by a narrow margin, finds a blanket waiver provision on page 5 line 21 Sec. 6 (a)(2). Immediately following all of the promises in the bill that only illegal aliens that claim they are under 30, claim they have been in the US 5 years, and claim they were brought here by others when they were under 16, and claim they are going to college or into the military, the waiver allows all of these considerations to be dropped.

"(2) WAIVER.—With respect to any benefit under this section and sections...the Secretary of Homeland Security may waive the... ground of inadmissibility ...and the ground of deportability... for humanitarian purposes or family unity or when it is otherwise in the public interest."

This provision will grant the Obama administration the power to declare full amnesty for the 12 to 20 million adult illegal immigrants in America!

I believe that the number of illegal human beings presently on American soil is more like 28 million. I base that estimate on:

1. The work of open borders Bear Stearns financial analysts Robert Justich and Betty Ng who, in late 2004, estimated that 20 million illegals were already here;

2. On a conservative figure of 500,000 net new illegals per year since then (a 2004 Pew Hispanic Center Report estimated, “Over the past decade the number of newly arrived unauthorized migrants added to the U.S. population has averaged 700,000–800,000 a year.”), and;

3. On at least five million “anchor babies” born to illegal human beings here, babies that have been granted citizen status, based on an erroneous interpretation of the 14th Amendment’s birthright citizenship clause. My VDARE colleague Ed Rubenstein estimates that 380,000 anchor babies will be born in America this year alone, a whopping 10 percent of all births.

In April, 2009, a report issued by the Pew Hispanic Center estimated that the number of anchor babies had risen over 48 percent, from 2.7 million to 4 million, from 2003 through 2008. However, the Pew report had what seem to me to be unrealistically low birth numbers—260,000 per year, and an unrealistically low base number of 11.9 million illegals. However, note that even if I used the Pew numbers for anchor babies, that would still give 4.4 million, 20 months after the report.

(In August, FAIR put the number of annual anchor baby births at 363,000, but its base of “13 million [illegals] in 2008” also sounds unrealistically low to me. Last month, Rep. Steve King (R-Iowa), chairman of the House Subcommittee on Immigration, estimated that 750,000 anchor babies are born per year in America.)

If they are amnestied, the illegals could sponsor at least three times as many relatives from abroad, not to mention the millions of children they would have in America. And amnesties notwithstanding, Ed Rubinstein “project[s that] 23.3 million anchor babies will be born to illegal aliens in the U.S.” between 2010 and 2050.
