Judge Denies Mistrial for Tulsa Man Accused of Hicks Park Murder
Judge Denies Mistrial for Tulsa Man Accused of Hicks Park Murder
By David in TN
In Day 3 of what are being called the Hicks Park Murders, defense attorneys asked for a mistrial when a witness testified about something the jury wasn't supposed to hear. (The news item doesn't specify what it was) The judge did not declare a mistrial, but told the jury to disregard it.
Jurors watched the video of the local ABC station's news story, in which defendant Darren Price "questions whether the park is a safe place to bring his children."
A police officer testified the gun used in the murders was found in the apartment of Gerard Davis, who has pleaded guilty and been sentenced to "life in prison."
Most of Thursday's witnesses "were officers, Crime Scene Investigators and forensic lab employees, testifying over evidence, to prove it wasn't planted or tampered with before trial."
