For Channon Christian: Photo Video and Material on the Knoxville Horror
Thanks to FarragutAlumni, who incredibly posted this video to youtube on January 9, 2007, a mere day after Knoxville Police Department Investigator Todd Childress found Channon Christian’s corpse stuffed in a garbage can in the house on Chipman Street.
Channon Christian was a Farragut High School alumna. Her old classmates, despite being wracked with grief, pooled their many pictures of her, and created this touching video, in order to ensure that she would not be forgotten.

White Supremacy and Plagiarism at CNN
On May 29, the CNN show, Paula Zahn Now did a story—well, sort of—on the crime I have dubbed the Knoxville Horror. In that January 7, 2007 atrocity, a young white couple—Channon Gail Christian, 21, and Christopher Newsom Jr., 23—were carjacked, kidnapped, both gang-raped, tortured and murdered in Knoxville, Tennessee. Four suspects in the rape-murder and one who is charged with being an accessory after the fact, all of whom are black, are in custody. Defendants Letalvis “Rome” Cobbins, Lemaricus “Slim” Davidson, George Geovonni “Detroit” Thomas and Vanessa Coleman are scheduled to be tried in separate state trials, beginning from May to August. In December, Knox County District Attorney General Randy Nichols announced that he will seek the death penalty for Cobbins, Davidson, Thomas and Coleman. Eric Boyd is charged with having harbored the fugitive Davidson after the slayings, and will be tried in federal court next month as an accessory after the fact to carjacking, which is a federal crime.
I say Paula Zahn Now “sort of” did a story, because guest host Kiran Chetry and reporter Rusty Dornin were not so much reporting on the crime as on the protests against the crime as yet another example of rampant, racially motivated black-on-white violence by what they referred to as “white supremacists.” (I refer to them as “white supremacist/neo-Nazi/whatevers –WS/NN/Ws.)
Reporter Rusty Dornin interviewed Knoxville News Sentinel reporter Jamie Satterfield in her newspaper’s offices, where Satterfield complained about all of the hate mail she’d been getting from white “racists” charging her with covering up the racial nature of the crime.
Satterfield is, to my knowledge, the only journalist to write more on the Knoxville Horror than I have. Prior to last May, she stuck to the facts of the case, but as the first, May 26 rally neared, she began producing editorials disguised as news stories, or what I call “reportorials,” attacking anyone who would state the obvious, to wit, that the kidnapping, gang rape, torture and murders of Channon Christian and Christopher Newsom were racially motivated.
Though Dornin never mentioned me by name, she suggested I am also a “white supremacist,” when she showed a screen capture shot of my May 14 American Renaissance Web report on the Knoxville Horror, as she narrated, “Sites with white supremacist agendas made their own headlines.” (Read the transcript here. See the video here.)
Dornin neglected to tell her viewers that that “white supremacist” Web site was where she (or her producer) had learned that Hal Turner had spread the rumor that the attackers had genitally mutilated their victims, which had burned across the Internet; thus, it was her primary source for that story. The genital mutilation rumor and an interview with Turner are among the highlights of her story. (The parenthetical references to Dornin’s producer are because in TV news magazines, typically the producer researches and writes the story, and even conducts the on-camera interviews. The so-called reporter is typically a mere performer reading the script the producer wrote for her.)
Since the other main aspect of Dornin’s broadcast, the May 26 Knoxville protest, had already been covered by the Knoxville media, without my work, Dornin would have simply echoed the Knoxville media, none of whom had tracked down the rumor. It was her plagiary of my work that allowed her to deceive her viewers into thinking she had done original research.
But why, a skeptical reader might ask, should anyone believe that Dornin plagiarized my May 14 story?
1. The screen capture shot of my May 14 story acknowledges that either she or her producer (depending on who wrote her script) read my story;
2. No one prior to me had tracked the genital mutilation rumors back to their source; and
3. Dornin even plagiarized an error I had made in my May 14 article, in identifying Turner as living “in New York.” He lives in New Jersey. I corrected that error in a revised, expanded version of the article that American Renaissance published in its July, 2007 issue.
Thus, there was nothing original in Dornin’s story.
(CNN identifies Turner as “HAL TURNER, EXTREMIST INTERNET BLOGGER,” rather than as a radio host, in order to use him for its ends, but without granting the quid pro quo of letting him gain any listeners. That’s not cricket. I am unaware of CNN ever identifying a leftist or black or mestizo racial supremacist as an “extremist,” or refusing to identify a radio host with such politics as a radio host. As it is, Turner is no longer broadcasting, but he was at the time.)
If American Renaissance has a “white supremacist agenda[s],” what does that make a reporter who plagiarizes American Renaissance?
Had Dornin done her homework regarding American Renaissance, she would know that its founder, Jared Taylor, has pointed out that he could more accurately be called an “Asian supremacist” than a white supremacist. Taylor is a race realist.
(For the record, while I consider myself a race realist, anyone who knows me knows that the notion that I would identify so strongly with any human collectivity that I would derive my feelings of superiority from membership in it, is ludicrous. If I were an adherent of any ideology, it would be that of Marxism: The philosophy, science, and praxis of Groucho Marx.)
Plagiarism is such a big issue because it involves stealing another person’s labor and an utter lack of intellectual (in this case, journalistic) integrity. It took me just under two months and over 200 hours to put together my May 14 story. Since Dornin or her producer ripped off my work, and used previously shot film of the May 16 rally, the story’s only time requirement involved the producer or an assistant reading my article and a few others, and Dornin or the producer flying out to Knoxville for one day to interview Satterfield. Had viewers known that Dornin and her producer had ripped off my story, they would have had a much different reaction to the script’s condemnation of American Renaissance as having “white supremacist agendas.”
One month after Paula Zahn Now presented its plagiarized Knoxville Horror story, CNN cancelled the program, which aired for the last time on August 2. Even stealing other people’s work could not buck up the show’s anemic ratings. The network did not make an offer to Zahn to continue working for it.
Zahn was replaced by host Rick Sanchez, who recently made a fool of himself trying to hype a minor, humorous moment in the John McCain campaign into a scandal. At a public forum, a female follower of the Arizona senator had asked of New York Sen. Hillary Clinton, “How do we beat the bitch?” In a desperate attempt to turn the moment into a story, Sanchez editorialized on-air endlessly about it, claiming that it had offended all women everywhere, or at least those among his studio staff, while presenting his socialist and feminist bona fides to viewers.
Googling under CNN + “plagiarism policy” returned 367 entries of stories that CNN did on other institutions’ plagiarism problems. This story will, to my knowledge, be the first entry on a plagiary committed by CNN.
It’s been a bad year for “TV news reader” Paula Zahn, who after having for years squandered all of her money on shopping sprees, cheated on her real-estate mogul husband of 22 years with another tycoon, was cancelled by CNN, and, in an attempt to squeeze her husband in divorce court, let herself be publicly humiliated by her divorce attorney.
Rusty Dornin is still a “reporter” for CNN.

The Knoxville Horror Never Happened, and There are No Marxists, Says Reader
The following letter came today from one of my legions of devoted Marxist readers:
In regard to your "Crime, Race, The Media, And "Anti-Racism"" article,
I feel it is necessary to make a few comments about the statements you
make.
Speaking as a close friend of several people who attended the entire
Mountain Justice Summer weekend in Tennessee, I know that the event
was about environmental impact. The "Coup Clutz Clowns" are not a
"front" for this organization, they're a persona adopted by the
counter-protesters to better demonstrate their message. MJS has
nothing to hide.
For such a passionate denouncer of the MSM, you seem to take a large
part of your impression of an event from media publications. Why do
you imply that most of the MJS delegation was from out of town? What
information besides media omission do you have to support this claim?
I seem to not understand. Please explain.
-A
My Marxist fan was referring to the following section from my October 31 VDARE article, “The Knoxville Horror: Crime, Race, The Media, and ‘Anti-Racism’”:
Linder’s First Rally
On May 26, [white supremacist Alex] Linder’s demonstrators are greeted by three hundred city, county, state and federal law enforcement officers in riot gear, who have spent weeks preparing for them.
The local and regional MSM claim that less than 30 protesters showed up. Reporters employ the propaganda tactic of asking all protesters where they came from, and describing them as out-of-state "white supremacists," and the demonstration as a "hate rally." In vilifying the protesters, while denying that the atrocity was racially motivated, local media imply that the protesters are worse than the rapist-torturer-murderers.
"Anti-Racists"
According to the ideology of "anti-racism" promoted by those who currently dominate the media, public schools, academia and "activist" organizations, blacks cannot, by definition, be guilty of racism, whereas whites are, by definition, racist. All blacks, no matter how rich, are victims, while all whites, no matter how poor, are privileged. Got it?
"Anti-racists" hate whites the way Alex Linder hates Jews.
Oddly, the majority of people who call themselves "anti-racists" are themselves white. And they are at times openly racist towards law-abiding blacks and blacks who do not hate whites sufficiently, particularly black Republicans and conservatives.
Sounds crazy? That’s because this stuff is crazy.
Virtually all Americans have encountered "anti-racism," aka "multiculturalism" and
"diversity education," in one form or another, most explicitly through diversity training in workplaces and educational institutions. In diversity training, whites are racially abused by vicious, dishonest trainers, who make a good living doing this.
Hate pays.
The First Counter-Rally
A lily-white contingent of men and women, all clad in long, frilly white dresses, simultaneously held a counter-rally.
The media identify the anti-white counter-demonstrators as "environmentalists" and as the "Coup Clutz Clowns," and imply that they are locals. They claim that twice as many of them showed up as those protesting the killings.
There are no "Coup Clutz Clowns." The name is a front that groups from different training camps of the "environmentalist" group, Mountain Justice Summer (MJS), in West Virginia, Virginia, Kentucky and Tennessee use when they disrupt the demonstrations of groups they oppose.
Why would "environmentalists" be so concerned about a demonstration against black-on-white murders? Because they aren't environmentalists.
"Environmentalism" is yet another front for a revolutionary Marxist outfit that seeks to destroy America through open borders and pseudo-scientific, "environmental" accords such as the Kyoto Protocol. (For the leftwing takeover of the American environmental movement, see here and here.)
Only one MSM report I find on the rally mentions Mountain Justice Summer, but without revealing its true character.
MJS training camps, which teach civil disobedience and manipulation of the legal system, are among the successors to communist training camps such as the Monteagle, Tennessee-based, Highlander Folk School.
The local media can find only one MJS counter-demonstrator from Knoxville, lawyer Chris Irwin. (Irwin is not wearing a dress.)
No news accounts of the rally report that Irwin is MJS' Knoxville "co-coordinator" [sic]. He is also the leader of "Knoxville Anti-Racist Action."
Local print and TV "reporters" make no attempt to hide their agenda, emphasizing with unwittingly comical exaggeration Irwin's local roots, while apparently not asking the other anti-white counter-protesters—who are from all over the country—where they hail from.
“Reporters” also refrain from politically identifying the counter-demonstrators as they do the demonstrators, say as "racists," "Marxists," or "extremists."
“Reporter” Mike McCarthy, of CBS' Knoxville affiliate, WVLT, approvingly quotes Irwin's surreal statements: "It's not the 1950s anymore!" as if the victims were black; and of the protesters, "They're not just a knife at the throat of the African American and [illegal] immigrant communities, they're a threat to us all."
One may debate how much sympathy the Jew-obsessed WS/NN/Ws really feel for Channon Christian and Christopher Newsom. But they do passionately express sympathy for the victims and their loved ones. The lack of any expression of sympathy for the victims and their families —or even mention of their names—by MJS' "anti-racists," however, is because … they feel no sympathy for them.
Knoxville Voice staff activist, Hilary Trenda, brags that the KPD colluded with the anti-white counter-demonstrators:
"KPD Lt. Robert Hubbs contacted Knoxville Voice May 25 while preparing security plans for the rally, expressing a desire to work with the counter-protestors and alleviate any surprises to KPD."[“At the End of the Day We Still Love You!" May 31 2007]
At the Christian/Newsom rally, Hal Turner says,
"[First,] we want to tell the liberal media we are tired of them spiking stories about black-on-white crime. Our second goal is to tell the black community they have to restrain their black hoodlums." [Police arrest organizer at 'rally against genocide', By Matt Lakin, Knoxnews.com, May 27, 2007]
Many of the pro-white protesters yell at their anti-white opponents, "If you're against racism, why weren't you here protesting the crime?"
I sent the following note to “Anonymous.”
What a pleasure to hear from you, Anonymous! I always love it when nameless people send me itty-bitty notes making unsubstantiated claims about yet other nameless ones, while demanding that I explain myself from scratch, as if I hadn't already written a 15,000-word article on the matter to be "explained."
The "Coup Clutz Clowns" are not a
"front" for this organization, they're a persona adopted by the
counter-protesters to better demonstrate their message. MJS has
nothing to hide.
Then why did they fail to mention that they were at the demo representing MJS? Or did they tell reporters, who in turn suppressed that information, believing that would better help MJS?
For such a passionate denouncer of the MSM, you seem to take a large
part of your impression of an event from media publications. Why do
you imply that most of the MJS delegation was from out of town?
I didn't "imply" it, I said it.
What information besides media omission do you have to support this claim?
What information do you have to discredit it?
I have some more questions for you:
1. Why would an “environmentalist” group try to sabotage a protest against racist violence?
2. Put differently, why would an “environmentalist” group support racist violence?
3. Why would an “environmentalist” group oppose the best available measure against pollution in the U.S. (a moratorium on all immigration)?
4. Why would an “environmentalist” group support measures intended to destroy Western economies, while not supporting any such measures against the two nations that will soon be (if they are not already) the world's biggest industrial polluters?
Please explain.
And I resemble the disrespect you showed the MSM's coverage of the counter-demonstration. Those folks bent over backwards to help your alleged friends.
I just noticed something, in preparing this post for publication. “Anonymous” did not cite the full title of my article; he cut out the beginning, “The Knoxville Horror.” For she/he/it, there was no Knoxville Horror.
For background on Alex "Don't Call Me a Neo-Nazi" Linder, read the following three-part interview.

Lawyer Has Published Book on the Racist Knoxville Horror Kidnapping-Gang Rape-Torture-Murder of Channon Christian and Christopher Newsom: “The Fact This Crime was Never Considered Racially Motivated by the Prosecution Stuns [Author Mike] Pelletier and Others, Including Family Members of the Victims”

War crime victims Channon Christian and Christopher Newsom
Re-posted by Nicholas Stix
I thank my friend and partner-in-crime, David in TN, who writes,
Someone has written a book, published last fall, on the Christian-Newsom murders. It looks to be good and he calls it for what it was—a racial murder. Unfortunately, it's only available on Kindle, not even a paperback. It appears no one would publish it in print.
Wonder why?
Knoxville News Sentinel reporter Jamie Satterfield, the only person to write more on this case than yours truly, said a few years ago that she was going to write a book on this atrocity. However, she has since changed direction, and may never write said book. Although she had always been a “liberal,” she had oscillated between being helpful and hostile towards me. Back in the spring of 2007, she even spent a few minutes helping me on the phone, when I called her at KNS.
Sometimes, we even had a friendly rivalry. During the May 2013 retrial of racist KH killer George Thomas (who was convicted), while I interviewed a member of the Knoxville Police Department, Jamie pounded a short diagonal path, so she could eavesdrop on the conversation. I spoke of being sandbagged for months by the KPD, and asked whether it would have helped, had I camped out outside Police Headquarters. The KPDer responded, “Nope.” Satterfield tossed over her shoulder—while marching back and forth—“We didn’t have that problem.”
She sure didn’t.
Several years ago, when the Knox County Medical Examiner reported that the semen of two additional black male rapist-murderers had been found in Channon Christian’s panties, Satterfield lied, in asserting that the semen was simply a mixture of the semen of half-brother rapist-murderers Lemaricus Davidson and Letalvis Cobbins. Even if it had been possible (which it isn’t) for two men’s semen to mix, thereby creating a new DNA profile, that would have only resulted in a third DNA profile, not a third and a fourth. Satterfield was again seeking to diminish the awfulness of the crime, which had at least seven participants.
A couple of years ago, Satterfield he announced that she was looking to change jobs in the news business. She suddenly started going out of her way to be openly racial socialist, apparently fantasizing that this would get her a gig with an outfit like CNN. It didn’t occur to her that CNN wasn’t interested in hiring pale, middle-aged white women, no matter how anti-white they are. (It likes “black” women who are light, bright, and damned near white.) So, she’s still stuck at the Knoxville News Sentinel. However, while I thought she’d write a book, in order to attack people who have been honest about the Horror, she apparently doesn’t want the world to learn about it at all. Maybe she’s afraid that people might not accept the racial fairy tale she wants to tell.
Then about two years ago, I twitted something, and she insinuated that I was a Klansman, responding, “Your white robe is showing.”
Roughly a year ago, Satterfield retweeted some inanity from a racist black female “journalist.” I called the black female racist a racist, to which the RBF immediately responded, “Blocked.” Although I hadn’t criticized Satterfield, she was loyal to the RBF, and immediately followed suit.

Lawyer and author Mike Pelletier has two bikes, Beauty and the Beast. Beauty is a Honda Shadow 750 and Beast is a Honda VTX 1800. The Beast is pictured here.
Author Mike Pelletier has his books available at amazon.com.
It can’t get much uglier than kidnap, rape and murder.
East Tennesseans who were living here back in 2007 know the case well. Channon Christian and Christopher Newsom were the victims of a crime so horrible it’s hard to believe other human beings were responsible. They were kidnapped in Knoxville, taken to a nearby house and tortured, raped and murdered. Chris was set on fire after being shot. Channon was left for dead in a trash can, wrapped in plastic garbage bags. They were a young couple in love with time to forge a future when they were brutally tortured, discarded like the evening trash.
Then, an unthinkable and ugly twist: the judge who presided over the trials had been a drug addict and was most certainly impaired on the bench, lawyers for the four defendants who were tried by the judge, maintained. New trials were granted to those four.
A memorial at 2316 Chipman St., the location where the despicable crimes occurred, features a cross and the words Together Forever. The house on the lot was torn down.
It stays with you
As a lawyer, Maryville’s Mike Pelletier has been interested in the case since moving here in 2011. He wasn’t here for the initial trials but has attended the retrials and talked with family members. Pages and pages of court documents and newspaper accounts have helped him piece together the case that consumed a community.
“This case wouldn’t leave me alone,” Pelletier said. “It is the most notorious crime in the history of Tennessee.”
What he’s learned, he’s now sharing in a book, aptly titled “Knoxville’s Endless Nightmare: The Christian-Newsom Murders.” It’s available on amazon.com.
The fact this crime was never considered racially motivated by the prosecution stuns Pelletier and others, including family members of the victims. It was five black men against a white man and white woman. It was just another murder case, said one of the prosecutors.
There was also little coverage of the senseless murders and trials anywhere other than here in East Tennessee, another fact Pelletier has a hard time understanding.
Stepping into their shoes
The lawyer in him became fascinated with the facts of the case and the shocking turn of events with the addicted judge. And because Pelletier is himself in recovery, Judge Richard Baumgartner’s story is one he can at least relate to from the standpoint of addiction.
“I had my last drink in April of 1984 because I was sick and tired of being sick and tired,” Pelletier said.
Then he puts himself into the shoes of Gary Christian, father of Channon and Hugh Newsom, father of Christopher.
“I particularly sympathize with Gary Christian and can’t imagine coping with an assault like this on my daughter, which takes us dads to the border between forgiveness and vengeance.”
There is no interest here in attention for himself or making money off of someone else’s misery. Pelletier said there are at least two lessons that can be taken away from all of this. One, that our criminal justice system should deal with “incorrigibles” like these swiftly and harshly. Second, that judicial misconduct be reported for the good of the system instead of being tolerated or covered up.
Getting to the bottom
“Knoxville’s Endless Nightmare” takes readers to the crime scenes with gruesome details included.
Pelletier said the book wasn’t meant for young or sensitive readers.
There are transcripts from defendants in the case, which is tough language to hear. And because the judge was taking drugs the entire
time, the cases he presided over may go on forever.
This isn’t Pelletier’s first book. He wrote “The Millstone Society,” about the sex scandal within the Catholic Church. He also authored a book based on the Gospels, entitled “Liar, Loon or Lord: A Journey Through the Gospels.”
“Profiles in Addiction,” about the famous alcoholics and addicts through the ages, will be his next.
Pelletier is licensed to practice law in Tennessee, but his practice is limited to appellate litigation, civil and criminal.
He volunteers his services for nonprofits, too, including two recovery clubhouses in Tennessee and his fire company in New Jersey where he lived before here.
He has represented anti-abortion protesters in criminal court free of charge.
What brought this author/lawyer to Maryville has nothing to do with law or books. Pelletier’s other passion is motorcycles.
The Blue Ridge Parkway is one of his favorite rides. He admits to tackling The Dragon here in Blount County, but at a safe speed and with full attention to the road.
“East Tennessee is motorcycle heaven,” Pelletier said.
He’s been riding motorcycles since 1991 and keeps a diary of his excursions.
Writing is a way for him to share his adventures. “The Motorcycle Diary” is also available on amazon.com.
That talent also serves him well with telling this horrific story. There are a lot of legal twists and turns that fascinate Pelletier and telling the whole story is what he’s set out to do. If that means adding chapters to his book, he will do just that as the legal battles over the judge’s impairment move on in this and other cases over which he presided.
“The judge’s addiction raises the possibility that this will never end,” he said.

I just watched the recording of the program on my DVR. People interviewed included prosecutor Leland Price, Jamie Satterfield, a novelist named Kalisha Buckhanon, and Jeffrey Gardere, who is a media talking head. Gardere was on In Session when they showed the Cobbins trial in late 2009.
The TV One show "For My Man" is an hour long with two stories 30 minutes each. Coleman is depicted as a nice middle class girl who falls for "bad boy" Letalvis Cobbins and was unaware of what she was getting into. Supposedly, Coleman didn't know about Chris. They infer he was kept in the trunk while Channon was brought into house, and was taken to the railroad tracks, tortured and killed there, while Vanessa was left alone with Channon.
Vanessa "went along by standing by her man" is the theme of the show. That Vanessa Coleman's family "stands by her and proclaims her innocence" is flashed on the screen at the end.
Overall, not a bad program, except for letting Coleman off (she had several chances to free Channon) too easy. Still, TV One deserves credit for doing a show on the crime. ABC 20/20, NBC Dateline, and CBS 48 Hours have not.

New TV Program About the Knoxville Horror

War crime victims Channon Christian and Christopher Newsom
By David in TN
I just found out somebody has made a TV program (partially) about the Knoxville Horror. It's on a black-oriented network called TV One. I never heard of it, but it's on my Direct TV package Channel 328. It might be on your cable. [It is; on Time Warner Cable NYC, it’s on channel 90.]
The title of the show is "For My Man." The theme is black women who get in trouble from "love of their man."
It premiered last month but it reruns early Sunday morning at 4 am ET. I've set my DVR to record it. Google "Vanessa Coleman For My Man."
The host of the show is one Tracey Reiyes who is a "crime reporter" or something. The show is an hour, telling two stories, meaning Coleman will take up half an hour.
Traciy Reyes' introduction to the episode from Inquisitr follows.
The Vanessa Coleman, Lemaricus Davidson Tennessee murder case and the Tamika Jasper Barbary drug trafficking case will be the featured stories for the next episode of For My Man. For My Man is a new crime documentary show that now airs on TV One about women who have gotten themselves in legal trouble because they loved their man. The show comes on just after TV One’s hit crime show, Fatal Attraction.
In tonight’s For My Man, viewers will learn about the case of Vanessa Coleman, a woman who was convicted in the 2007 Tennessee deaths of 21-year old Channon Gail Christian and her boyfriend, 23-year old Hugh Christopher Newsom Jr.
Channon and Christopher were kidnapped from their vehicle after leaving an apartment in the area. When they were abducted, they were taken back to a home where they were raped and tortured for hours. It’s an incredibly sad case, but a bit controversial. The victims were white. The perpetrators were all black, which caused tremendous outrage in the community. The case was heavily criticized by whites who felt that the case was ignored by the media, since it was a case of black on white crime. Since that time, some white hate groups have constructed various pages that call for the deaths of the killers, but are peppered with #BlackLivesMatter information. Vanessa Coleman, along with the other accomplices, are currently incarcerated in a Tennessee correctional facility.

Thanks to my friend and partner-in-crime, David in TN, for this article.
Readers of my last Knoxville Horror posting five days ago may be confused to read of the Tennessee Supreme Court in this posting, after reading of the U.S. Supreme Court in the previous one. The answer is simple: Today’s posting is about the attempt by Lemaricus Davidson’s lawyers to thwart justice, while the previous posting was about the attempt by George Thomas’ lawyers to thwart justice.

For torture-killing ringleader Lemaricus Davidson, his appeal to the Tennessee Supreme Court on Wednesday brought good news and bad.
The good? The high court justices are interested in his strongest argument for a new trial. The bad? They look to that issue to craft new law that would dash Davidson's appellate hopes.
The justices heard arguments Wednesday in Knoxville in the appeal of Davidson, who was sentenced to die for his role in the January 2007 carjacking, kidnapping, beating, rape and killings of Channon Christian, 21, and Christopher Newsom, 23. It is an appeal guaranteed by law in all capital cases.
The justices will weigh various issues surrounding Davidson's case, but made clear by their questions they are interested in using a search warrant foul-up to explore the possibility of what is known as a "good faith exception" under the law.
Federal courts long have used such an exception to essentially forgive honest mistakes, such as clerical errors, by police that lead to flawed legal documents, such as search warrants. Typically, if a search warrant is deemed legally flawed, whatever evidence is discovered as a result of that search is tossed out. If, however, a court determines the police were acting in good faith — officers didn't lie, for instance — when obtaining and executing the warrant, the evidence can be saved.
Tennessee courts have repeatedly declined to adopt a good faith exception. In 2011, the state Legislature created one. That law would not apply in Davidson's case, though, and the state's high court has not yet been asked to rule on whether that 2011 law is constitutionally valid.
Justice Jeffrey Bivins said during Davidson's appeal the high court already has one case ripe for consideration of the creation through case law [?!] of a good faith exception, and Davidson's case could provide fodder in that as well.
"This court has the authority to adopt that, and we want to know if we should adopt that," Bivins told attorney David Eldridge, who represents Davidson.
A good faith exception is intended to cover innocent, clerical mistakes — a wrong time or date, for instance. The justices Wednesday repeatedly said it appears the mistake in Davidson's case — a missing signature line and a signature in the wrong place on the warrant — was an honest one.
Eldridge countered the mistake at issue is more serious than a clerical error. Here's why: An officer's signature on a search warrant application is proof that officer swore under oath that the facts therein are true. No signature, no proof, Eldridge said. Also, because the officer in Davidson's case signed the warrant in a slot reserved for the signature of the officer who served the warrant, it runs afoul of a provision of the law that bars the officer seeking the warrant from also executing it.
"Failure to comply with the legal rules of procedure is pretty significant," Eldridge said.
The state Court of Criminal Appeals has held that because police already had amassed evidence against Davidson as a suspect and had discovered Newsom's body and Christian's missing vehicle near Davidson's house, authorities inevitably would have found Christian's body through legal means. It's known as the doctrine of inevitable discovery and in Davidson's case, it saved the day for prosecutors at trial.
The warrant mix-up occurred because lead investigator Todd Childress chose the wrong size paper to fax a copy of the warrant and supporting affidavit to a Knox County General Sessions Court judge for approval. The signature line wound up cut off from the document, and Childress inadvertently signed the document in the wrong place.
The mistake was discovered within minutes of the entry into Davidson's home, by then left vacant, but an officer found Christian's body before commanders ordered the raiding team to back out. A second search warrant — with the proper signature line and signature — was then obtained.
It could be months before the justices rule.
Christian and Newsom were carjacked and kidnapped outside the Washington Ridge Apartments and taken to Davidson's house, where both were beaten and raped. Newsom was taken from the house to nearby railroad tracks, where he was shot execution-style and his body set on fire. Christian was held captive for several more hours and repeatedly raped. She was stuffed alive inside a trash can and left to die.

Sloppy investigations and a drugged judge is nothing to be proud of. The one thing that our police are good at is beating inmates, but that does not bring convictions for these awful crimes.

T.E. you don't have to post comments first thing every morning with no substance just to see your name in print. Was the "good at beating inmates" comment really necessary, relevant, appropriate, or even accurate? Just listen to yourself, you are starting to sound like CJ. How much time have you spent in a dealing with violent individuals in a jail setting? Stick to the subject of the article or something you actually might know something about.

Hensley takes every opportunity to denigrate people. I've yet to see a reasonable argument from him.
RICHARD & MARIANNE FISCHER - Yesterday at 7:56 AM
There have always been two problems with the exclusionary principle. First, it was originally just an arbitrary decision by SCOTUS as a remedy for the police deliberately violating the "reasonable search" right in the Constitution, in the case before SCOTUS at the time. SCOTUS has no authority to, and did not, create a new right in the Constitution.
Second, there is no right in the Constitution for a "perfect search". Clerical errors, misspelled words, and the like do not constitute willful [sic] violate [sic] the Constitution, which only requires "reasonable" searches. Nothing in the Christian/Newsom search was "unreasonable".

Knoxville Horror News: New Laws Just Enacted in Tennessee, and a Possible Additional Retrial

War crime victims Channon Christian and Christopher Newsom
Re-posted by Nicholas Stix
My partner-in-crime, David in TN, hinted the other day that one member of the gang that carjacked, kidnapped, beat, gang-raped, tortured and murdered Channon Christian and Chris Newsom on January 6-7, 2007, may get a(nother) retrial, but without specifying whom he was thinking of. And on July 1, two new Tennessee laws named after Christian and Newsom went into effect (see below).
New TN laws take effect on July 1st
Starting next week, several new laws will take effect in Tennessee. Some bills received a lot of attention in the legislature-- they range from protecting victims in trials to cutting down on meth. 6-27-14

(WBIR) Beginning on July 1st several new Tennessee laws will take effect.
Among the new laws is Governor Bill Haslam's anti-Meth law. It's one of the key pieces of legislation Governor Haslam supported this year. The new law limits the amount of pseudoephedrine people can buy to less than six grams a month. Pseudoephedrine is a key ingredient to make meth and lawmakers are hoping cutting down on sales of over-the-counter medications will help curb meth use.
Two laws in memory [sic] a Knoxville couple murdered in 2007 will also take effect. They're named after the victims, Channon Christian and Chris Newsom. The new laws aim to change the justice system. The Chris Newsom Act takes away the state's 13th juror rule, which requires a judge to sign a unanimous verdict. The Channon Christian Act prevents attorneys from bringing up allegations of a victim's past that are not related to the case [sic]
Yet another law is named after an East Tennessee victim. Amelia's Law allows judges to order offenders and parolees to wear a monitoring device if alcohol or drugs played a role in their crimes. The device tests blood for alcohol and drugs every 30 minutes on convicted criminals.
Finally, there's the law aimed at protecting unborn children. Under the new law, prosecutors could charge any mother caught abusing drugs while pregnant unless she seeks treatment.

KNOXVILLE (WATE) - Loved ones of Chris Newsom and Channon Christian are remembering the young couple, as this week marks seven years since their brutal murders.
A crowd of people gathered at Newsom's grave site in Powell Sunday, putting down flowers and holding balloons in his honor.
Several of Christian's loved ones attended the ceremony, too.
Newsom and Christian were carjacked, raped and murdered early Jan. 2007 in East Knoxville. Four people have been found guilty in their murders.
Newsom's parents said they gather to remember the couple every year so that their stories never fade away.
"We don't want anyone to ever forget what happened to Chris and Channon and we want to keep their memory alive," Hugh Newsom, Chris Newsom's father, said.
"He used to make me laugh all the time and I'll remember that and miss that," Mary Newsom, Chris Newsom's mother, said. "He'd come in the house and he'd always stand at the door and go, ‘Hi mom,' and I miss that a lot. Sometimes I look over at the door and still see him standing there doing that."
