bLACK lottery ticket purchased Jordan Neely’s father—he’s suing Daniel Penny in supreme court, to get a higher monetary award

“(n.y. post) Jordan Neely’s father is suing Daniel Penny over his son’s chokehold death on a new york city subway car as the jury still deliberates whether to convict Penny of manslaughter.

“the suit, filed in new york supreme court on wednesday, accuses the long island Marine veteran of negligent contact, assault and battery that caused injuries and Neely’s death last year.

“Neely’s father, Andre Zachary, ‘demands judgment awarding damages in a sum which exceeds the jurisdictional limits of all lower courts which would otherwise have jurisdiction,’ according to the lawsuit.

“it was filed wednesday as jurors in Penny’s four-week-long manhattan trial broke for a second time without reaching a verdict.”

GRA: He’s hoping for a guilty verdict and a quick cash-in.

(abc7)Judge Maxwell Wiley has dismissed the top charge of second degree manslaughter at the request of prosecutors.
NEW YORK -- Judge Maxwell Wiley informed the jury he is dismissing the manslaughter charge against Daniel Penny after the jury signaled twice it could not reach a unanimous verdict.

He said he will encourage the jury to continue deliberating on Monday the lesser charge of whether Penny committed criminally negligent homicide in the death of Jordan Neely, a homeless man, on the New York City subway last year.

Defense attorney Thomas Kenniff opposed the move, arguing the move could lead to a "coercive or a compromised verdict." He again encouraged the judge to declare a mistrial.

The judge sent the jury home for the weekend and told jurors they would return Monday to deliberate on the lesser charge of negligent homicide.

"Whether that makes any difference or not I have no idea," Wiley said.


Once the jury exited, the defense said there was an article reporting a juror had expressed frustration to a reporter about the deliberations.


Lindsay Tuchman has more from Lower Manhattan on the jury deliberations.
"It may just be fake news but it's a concern obviously," defense attorney Tom Kenniff said.

The judge said he was disinclined to speak to jurors at this stage of the trial.

"If you want to go investigate, feel free," Wiley said.

The judge's decision came hours after Manhattan jurors sent him a note saying they were unable to agree on a manslaughter verdict. Jurors had previously been instructed that they needed to reach a verdict on the top charge before they could consider the criminally negligent homicide charge.


The jurors have been deliberating since Tuesday on whether to convict Penny.

(Breitbart)"According to court docs, Neely was high on K2, a synthetic marijuana drug known to function as a stimulant. Neely had a long history of criminal activity and at least one other assault incident in the subway in 2021 when he allegedly attacked a 67-year-old woman."

GRA:So Penny prevented another Neely attack in the near future,because the NYC(Adams)apes in charge were not going to stop him. Penny shouldn't have been charged in the first place,except that "black law" advocates run the big apple.
