    Unarmed at the moment he exited the car and fled on foot. If he had not fled in the car first and then fled on foot he would probably still be alive. Just don't flee. But emotion clouds reason. Michael Corleone himself said so. And with them emotion far clouds reason.

    Very dark outside at the time of the incident. Cops REASONABLY he had a gun.

    How could he be unarmed?He fired shots from his vehicle.Now maaaaybe,he attempted to make the cops look bad by ditching his weapon,but he WAS armed at some point--and the police chief correctly stated,"Once that happened(shots fired),it changes everything."

    There's no guarantee about his status of being armed/unarmed after attempting to shoot at a cop.You assume he IS packing.
